Less Conveyancing And More Prosecution
Representations
December 2007
Since July 1, there has been a reduced number of conveyancing transactions and
more work for Licensing Specialists in the Licensing Court representing
hoteliers for a wide range of prosecutions from RSA, compliance in terms of
gaming and signage and other Liquor Act and Liquor Regulations matters.
Over the past five years the level of compliance for the industry has blossomed
to the point where often the enforcement representatives such as the Police can
not even keep up with what is right and what is wrong.
Some hoteliers claim that within one week they have had Police and Department of
Gaming & Racing enforcement officers attending their hotels and to find
different potentially prosecutable offenses and in some cases have the same
inspector attend the premises over a two year period to discover built form
non-compliance that had not changed since gaming rooms were constructed and
previously been inspected.
This compliance and prosecution push is seen suspiciously as a revenue raising
exercise from what is perceived as a bottomless bucket of funds and all parties
involved in the Industry should lobby their local State Member and the
Sub-Branch President of the Australian Hotel Association so this matter can be
dealt with at both a State and Federal level by the industry association.
